Terms and conditions
Area of application:
The following general terms are only valid for the business relations between MJM-Vertriebs GmbH and the customer and govern any contract between both parties. Different terms and conditions will not be accepted by MJM-Vertriebs GmbH, except if the company expressly agrees to their validity in writing.
Approving and withdrawing from contract:
The customer can withdraw from the contract in writing or by returning the goods within two weeks from the day after receipt of goods. If the value of the order amounts to more than EUR 40,- MJM-Vertriebs GmbH will reimburse the costs of returning the goods. In case the returned item shows any kind of depreciation in value the company will not provide a refund of the full retail price. We will transfer the refunded amount to the bank account you specified in your order. If there is no bank account specified we will send you a check with the refunded amount. Your order is only accepted after the goods are dispatched to the address you specified in your order. Until this point, no contract for the sale of goods exists.

Order:
An order can be placed either online on our web site, by e-mail, fax, writing a letter or phone. There is no minimum order value.
Payment, maturity, delay:
You pay prior to delivery, or cash on delivery. You may also pay with your debit or credit card. Custom-made products and orders from abroad must always be paid in advance. If the customer is in delay of payment MJM-Vertriebs GmbH is authorized to demand a default interest rate of 5 % as specified by the European Central Bank.
Possible Changes to Product: :
The offered goods are hand made products and continuously being modified. Therefore, the pictures on our web site or in our catalog may be slightly different from the actual item sent to you.
Prices:
All prices are in euros and include applicable sales tax (VAT – value added tax). For companies and business customers the sales tax is shown separately. The prices in our catalogs and in other advertisements of MJM-Vertriebs GmbH are suggested prices and therefore not binding. The current price list is always valid. The offers are subject to change without notice.
Shipping:
Within Germany all goods will be delivered by the postal service. The postal charges are shown on our web site under “Shipping & Returns”. To receive delivery in countries in Europe other than Germany, you will pay postal charges of at least EUR 9,99 . For delivery outside of Europe the postal charge will be calculated separately according to the individual case.
Retention of title, place of jurisdiction:
The title of goods will pass to the customer at the point MJM-Vertriebs GmbH receives the full amount of payment, or when the refunds are credited to the company’s account. Place of jurisdiction is Hamburg.
Delivery:
Goods in stock will be delivered as fast as possible. The date of delivery is subject to change, unless MJM-Vertriebs GmbH has agreed to deliver on a specific date as a special exception. Custom-made products require a production time of about 3-6 weeks. We reserve the right to deliver the goods in separate consignments in case an article is temporarily out of stock. MJM-Vertriebs GmbH will bear the costs of any additional delivery.
Charges for post and packaging:
The charge for post and packaging will amount to at least EUR 5.90 .
Liability for faulty goods:
If a purchased article is defective, the customer may request a replacement or for the product to be repaired. If this fails to please the customer and the product shows a significant defect he may withdraw from the contract, abate the price of the good or claim for damages. As long there is nothing else mentioned below further customer claims (on whatever legal ground) are not valid. MJM-Vertriebs GmbH is only liable for damages which are found on the article itself. MJM-Vertriebs GmbH is in particular not liable for lost profit or any other financial losses of the purchaser. If the company is not liable or only partly liable, the same applies to the liability of employees, representatives and company’s agents. The limitation of liability mentioned above does not apply if the damage is caused by intention, gross negligence or personal injury. It also does not apply if the customer claims paragraph §§ 1.4 of the Product Liability Act. If MJM-Vertriebs GmbH negligently commits a breach of contract the liability to replace damaged goods is limited to the original damage.
Guarantee, notice of defect:
Your right of guarantee implies that you have inspected the goods when received and immediately made a complaint in case a defect is discovered. Notifications of defects and complaints are to be sent to the following address:

Protection of data privacy:
To process customer data MJM-Vertriebs GmbH uses Secure-Socket-Layer (SSL), one of the most secure encryption software for data transmission used within the internet. All information transmitted will be encrypted before being forwarded to us. Any data necessary for processing business transactions will be saved and, if need be, passed on to businesses affiliates. All personal data is always kept in confidence.
